Judge Rules against putting idle slot machines at a horse track
In a recent turn of events a judge has turned down a request Thursday for an injunction which would have placed idle slot machines of games such as “Instant Racing” at the famous Kentucky Downs racetrack located in Franklin, Kentucky.
The Appeals Judge of Kentucky Court Glenn E. Acree has said that the Family Foundation was not able to show any irreparable injury right away. The Family Foundation has mainly asked the court to turn off the slot machines. This request is a big part of an earlier appeal to lower the court ruling which was made in December in part to make these games legal.
The Acree has stated that their alleged harm is substantial plus the criminal violation of the given statues is also a big concern. Now the Court of Appeals will get back to his issue in October. However, Kent Ostrander who is the executive director of the group said that he is expecting to prevail. He stated that the installation of these slot machines is a departure from what the state law as well as policy dictates.
Ostrander when interviewed said that everyone in Kentucky should be concerned about this change in policy, which comes without any input from the elected representatives as well as the voters.
Bill Flesher who is the spokesman for Kentucky Downs has applauded this ruling and said that he personally believes that it confirms this track has a good footing in its legal right to offer Instant Racing slot machines. The history of gambling on horses in Kentucky goes way back. However, proponents of gambling have been pushing to allow the installation of slot machines on horse tracks. Around three years back they were also asked to legalize casinos.
